1. Acceptance of Terms

By accessing or using HyperPotion (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes means you accept the new terms.

2. Description of Service

HyperPotion is a research tool that provides modeled fair-value estimates and over/under signals for Pokemon TCG cards and sealed products based on publicly available pricing data. The Service is for informational purposes only.

3. Not Investment Advice

HyperPotion does not provide investment, financial, legal, or tax advice. The verdicts, residuals, conviction tiers, and any other signals are model outputs, not recommendations to buy or sell. You are solely responsible for your own decisions and any losses resulting from them.

Pokemon TCG products are collectibles, not securities. Prices are volatile and there is no guarantee past performance, model accuracy, or current signals will predict future returns.

4. Accounts

You must provide accurate information when creating an account. You are responsible for the security of your account credentials and any activity under your account. Notify us immediately of any unauthorized use.

5. Subscriptions & Billing

Premium features require a paid subscription. Subscriptions auto-renew at the end of each billing period until cancelled. You may cancel at any time from your account; access continues through the end of the current period.

We offer a 7-day refund window on first-time subscriptions. Annual plans may be prorated on request. Payments are processed by Stripe; we do not store payment card information.

6. Acceptable Use

You agree not to:

• Scrape, mirror, or systematically extract data from the Service without written permission
• Resell, redistribute, or sublicense Premium content
• Reverse engineer or attempt to derive the underlying model
• Use the Service to violate any law or third-party rights
• Interfere with or disrupt the Service or its infrastructure

7. Intellectual Property

The Service — including the model, leaderboards, documentation, and design — is owned by HyperPotion and protected by copyright and other laws. Pokemon, character names, and card images are property of their respective owners (The Pokemon Company, Nintendo, Game Freak, Creatures Inc.). We make no claim to those marks and use them only to describe publicly traded products.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to accuracy, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that prices, residuals, or verdicts are correct at any given time.

9. Limitation of Liability

To the maximum extent permitted by law, HyperPotion shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or trading losses — arising from your use of or inability to use the Service. Our total liability is limited to the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these terms or any conduct we determine harmful to the Service or other users. You may delete your account at any time from your account settings.

11. Governing Law

These terms are governed by the laws of the jurisdiction where HyperPotion is incorporated, without regard to conflict-of-law principles.
